What Security Deposit Calculator does
The security deposit is one of the biggest single payments when you move in, and yet the point where the most nonsense gets told. Let us start with the basic rule: under Section 551 of the German Civil Code the deposit may be at most three net cold rents. Not the warm rent, not including utilities - the pure cold rent is the basis. The calculator shows you your limit instantly and whether a demanded deposit exceeds what is allowed.
You do not have to pay the deposit in one go. The law gives you the right to pay it in three equal monthly installments, with the first due at the start of the tenancy. The calculator splits the sum automatically so you know what falls due when - a right many landlords do not offer on their own.
Your deposit money still belongs to you, and it must be held separately from the landlord assets and earn interest. The calculator simulates how much interest builds up over the years - for long-term tenants a noticeable sum accrues that is owed to you at repayment. Germany top court has struck down many clauses: rigid renovation schedules are generally void, and anyone who took over an unrenovated flat without compensation usually does not have to repaint on leaving. Frequently asked questions
What is the maximum security deposit?
Under Section 551 of the Civil Code, at most three net cold rents. The basis is the pure cold rent without utilities or heating. If the landlord demands more, the agreement is void to that extent and you can reclaim the excess.
Can I pay the deposit in installments?
Yes. The law allows three equal monthly installments. The first is due at the start of the tenancy, the others in the two following months. The landlord cannot exclude this right.
Does the deposit have to earn interest?
Yes. The landlord must hold the deposit separately from their own assets and at standard conditions. The interest is owed to you and paid out with the repayment. Over long tenancies that can be a noticeable amount.
Can the landlord deduct drill holes from the deposit?
Usually not. Ordinary dowel holes from pictures and shelves count as contractual wear and may not be deducted. It is different with an unusually high number or with real damage. The calculator classifies the typical cases with rulings.
When do I get my deposit back?
After you move out the landlord has a reasonable review period, often several months. For a still open utility bill they may hold back a reasonable portion until it is available. The rest must then be paid out promptly. The calculator estimates the deadlines and generates your letter.
