What Garnishment Exemption does

A wage or account garnishment feels like the ground being pulled from under you. In fact the law protects exactly that ground: a certain part of your income is exempt from garnishment so you can keep paying rent, food, and electricity. The garnishment exemption calculator makes that protected amount visible instead of leaving you in the dark about what stays with you.

The central provision is Section 850c ZPO. It sets a monthly basic allowance below which nothing may be garnished, and governs how above it only part of the excess can be taken. The exact amounts are adjusted every year on 1 July because they are tied to the development of the tax-free basic allowance. Frequently asked questions

How much of my wage is garnishable?

Up to the monthly basic allowance under Section 850c ZPO your income is entirely exempt. Above it only part of the excess may be garnished, graduated by the level of income and the number of your maintenance obligations. The calculator determines the concrete amount.

What is a P-Konto?

A P-Konto is a garnishment protection account under Section 850k ZPO. Any current account can be converted into one. Then the basic allowance is protected immediately and automatically, even while an account garnishment runs - the protected balance stays available to you.

Does the exemption rise with children?

Yes. For every person you legally owe maintenance, your garnishment-free amount rises. The calculator accounts for the number of dependents. On the P-Konto you prove the maintenance obligations with a certificate to obtain the raised protection.

Why can maintenance garnish deeper?

Under Section 850d ZPO maintenance claims take priority. Someone entitled to maintenance from you can therefore garnish deeper into your income than an ordinary creditor, because the law specially protects ongoing support. The calculator handles this case separately.
