What Power of Attorney Generator does

A power of attorney is a surprisingly powerful piece of paper: it lets another person act legally binding in your name. That is exactly why precision matters - too narrow and your representative cannot help; too broad and you hand over more power than intended. The generator walks you through the decisions without requiring you to have read the entire Civil Code.

The basis is the law of agency in Sections 164 ff. BGB. Whoever holds a valid power of attorney makes declarations that take effect for and against the principal. On top of that the generator builds ten typical types: general, banking, postal, litigation, precautionary care, care directive, child travel authorization, vehicle, real estate, and a special power for a single transaction.

Two points most samples stay silent on are built in here. First, exemption from the self-dealing ban under Section 181 BGB: without it your representative cannot conclude a transaction with themselves, which is often intended in family powers of attorney. Second, the transmortale power that remains valid beyond death, so the bank does not freeze the account before the certificate of inheritance arrives. Both can be switched on or off deliberately.

For advance care planning, the power of attorney is the central building block. A precautionary power (Vorsorgevollmacht) decides who acts for you if an accident or illness leaves you unable to - and in the best case spares you court-appointed guardianship. The generator reminds you to register it with the Federal Chamber of Notaries central register so it is actually found when needed.

An honest note: for banking, postal, or travel powers, written form is usually enough. For real estate transactions and certain cases the law requires notarial certification or authentication - the generator flags this instead of pretending every power is form-free. Does a power of attorney need to be notarized?

In most cases, no. Banking, postal, or travel powers are fine in written form. For real estate transactions and certain special cases the law requires notarial certification or authentication. The generator flags this when it applies to your power.

What does transmortale power mean?

A transmortale power remains valid beyond the principal's death. That is practical because the representative can still act after death without waiting for the certificate of inheritance, for example to handle ongoing matters.

What is the Section 181 self-dealing exemption?

Under Section 181 BGB a representative generally may not conclude a transaction with themselves. In powers between family members that is often intended. With the exemption you expressly permit such self-dealing.

Can I revoke a power of attorney?

Yes, a power of attorney can generally be revoked at any time. If in doubt, ask for the original back and inform any offices where the power was presented so it can no longer be used.

Why do I need a precautionary power?

A precautionary power decides who acts for you if illness or an accident leaves you unable to act. It can replace court-ordered guardianship. Registering it with the Federal Chamber of Notaries central register is advisable.

Does the generator replace legal advice?
