Rent Increase Check

A letter from your landlord, the rent is going up, and at the bottom it says "please consent by ...". The Mieterhöhungs-Check reads along with you: you enter the figures from the letter, it checks the cap, the comparative rent, deadlines and form under the German Civil Code and writes the matching reply. For increases based on the rent index, index-linked rent, graduated rent and the modernisation surcharge. A check against the statute, not legal advice, and everything stays in your browser.

What Rent Increase Check does

The most common rent increase is the one up to the local comparative rent under § 558 BGB. The landlord cannot simply impose it, he needs your consent. Fixed rules apply: the demand must come in text form and give reasons, using the rent index (Mietspiegel), a rent database, an expert report or at least three comparable flats (§ 558a BGB). If your municipality has a qualified rent index, the landlord must always state its values. If that is missing, the demand is formally void, and the tool tells you so in red.

On top of that there are two upper limits. The new rent may not exceed the local comparative rent, and it may rise by at most 20 percent within three years. In municipalities that a state ordinance designates as a tight housing market, the limit is only 15 percent (§ 558 Abs. 3 BGB). Increases for modernisation or service charges do not count. The check recalculates both limits, takes the lower one and shows for the big cities whether the 15 percent cap applies there according to its data. Because ordinances change, every hint asks you to check the current ordinance.

Timing matters too. A new demand is allowed at the earliest one year after the last increase, and the new rent applies at the earliest once the old one has been unchanged for 15 months. You have until the end of the second calendar month after receipt to think it over; the new rent takes effect from the third (§ 558b BGB). Important: silence is not consent. But if you pay the higher rent several times without reservation, that can count as consent. Until the end of the consideration period you can also give extraordinary notice (§ 561 BGB). The check works out all dates and adds them to your deadline tracker with one click.

With an index-linked rent under § 557b BGB the rent follows the consumer price index of the Federal Statistical Office. The check has the official monthly values (base 2020 = 100) built in and recalculates: current rent times new index divided by old index. It checks whether the letter states the index change and the euro amount, whether a year has passed since the last adjustment and from when the new rent is really due, namely from the month after next following receipt. If your contract still names the old base 2015, simply enter the points yourself.

With a graduated rent under § 557a BGB the increases are already in the contract. They must be agreed as euro amounts, with at least one year between two steps. An extra increase based on the rent index or for modernisation is then excluded. After a modernisation the landlord may pass on eight percent of the costs a year (§ 559 BGB), after deducting the repair share and grants, but at most three euros per square metre within six years, or two euros if the rent was below seven euros per square metre. If the modernisation was not announced properly (§ 555c BGB), the increase applies six months later. And if it becomes too expensive for you, there is the hardship objection.

At the end you get a traffic light for every check with its section, the highest rent permitted by your figures, and a finished letter in the German DIN 5008 layout: consent, partial consent up to the permitted amount, a refusal with reasons or a request for evidence. The check fills in the sender from your Amtsprofil if you like; you can edit, print and file the letter in the Aktenschrank. It does not replace advice: in a dispute, a tenants' association that knows your case can help.

How it works

  1. 1

    Pick the kind of increase

Rent index, index-linked rent, graduated rent or modernisation. If the letter says "§ 558" or "Zustimmung", it is usually the first.

  2. 2

Enter the figures from the letter

Date of receipt, current and new rent, reasoning, floor area and rent index value, for an index rent the two index months.

  3. 3

Read the traffic lights and save the deadlines

Every check with its section, plus the highest permitted rent and the dates for the deadline tracker.

  4. 4

    Send the reply

Check the letter, adjust it, print it and send it so you can prove receipt, for example by registered mail.

Who needs this

→Tenants with a rent increase demand based on the rent index in their mailbox
→Households with an index-linked rent who want to recalculate the adjustment
→Tenants after a modernisation with new windows, insulation or a lift
→People with a graduated rent who received an extra increase
→Relatives helping older parents reply to the landlord

Frequently asked questions

Do I have to consent to a rent increase?

You must consent to a formally correct increase up to the comparative rent that keeps the cap and the waiting periods, otherwise the landlord can sue for consent. You need not consent to a void or excessive increase; partial consent is allowed. The check shows what applies based on your figures. For your individual case, a tenants' association can help.

What happens if I do not reply at all?

Silence does not count as consent. After your consideration period the landlord can sue for consent for three months. But if you pay the higher rent several times without reservation, that may be treated as consent. A clear reply, which the check writes for you, is better.

Where does the 15 percent cap apply?

Where the state government has designated it by ordinance, for at most five years (§ 558 Abs. 3 BGB). In Berlin and Hamburg it applies citywide, in many states in individual cities and municipalities. The check knows the ordinances and the larger cities in them, with an as-of date. Still, check your state's current ordinance, it changes regularly.

How is an index rent calculated?

Current net cold rent times the new index level divided by the index level of the last adjustment. The relevant index is the consumer price index for Germany of the Federal Statistical Office, now on base 2020 = 100. The rent must stay the same for a year each time, and the new rent is due from the month after next following receipt of the declaration.

How much modernisation surcharge is allowed?

Eight percent a year of the costs spent on your flat, after deducting the repair share and grants. The rent may rise by at most three euros per square metre within six years, or two euros if the rent was below seven euros per square metre (§ 559 BGB). Special rules apply to heating replacements and the simplified procedure.

Can I give notice after a rent increase?

Yes. After an increase up to the comparative rent or for modernisation you can give extraordinary notice until the end of the second month after receipt, effective at the end of the month after next. The increase then does not take effect (§ 561 BGB). The check gives you both dates.

Does the check replace a tenants' association or a lawyer?

No. It compares your figures with the statute and helps you prepare your own reply. Placing your flat in the rent index, special cases and disputes belong with a tenants' association or a tenancy lawyer.
