Flight Passenger Rights — EU Regulation 261/2004
EU Regulation (EC) No. 261/2004 governs passenger rights for delays, cancellations, denied boarding, and missed connections. It applies to all flights departing from the EU or arriving in the EU with an EU carrier.
Compensation by Distance
- €250: Flights up to 1,500 km
- €400: EU flights over 1,500 km or other flights 1,500–3,500 km
- €600: Flights over 3,500 km
Requirements
Compensation applies for cancellation (less than 14 days notice), arrival delay over 3 hours (ECJ "Sturgeon" ruling, C-402/07), denied boarding due to overbooking, and missed connections with 3+ hour delay at final destination.
Extraordinary Circumstances — No Claim
Airlines are exempt for "extraordinary circumstances": severe weather, volcanic eruptions, air traffic control strikes, security risks. Technical defects are generally NOT extraordinary (ECJ "Wallentin-Hermann", C-549/07).
Baggage Rights — Montreal Convention
Lost, damaged, or delayed baggage falls under the Montreal Convention. Maximum liability: ~€1,500 (1,288 SDR). Report damage within 7 days, delay within 21 days of receipt.
