Co potrafi Sorgerecht-Erklärer

Custody is one of those terms everyone uses and hardly anyone knows precisely. Yet it decides everyday things like a nursery place and fundamental ones like where the child lives. German law governs it in Sections 1626 to 1698b of the Civil Code, and the central guiding principle is always the same: the welfare of the child. The custody rights explainer translates these sections into plain language and relates them to your specific situation.

Whether you hold custody jointly depends mainly on whether you are married. For married parents joint parental custody exists automatically from birth. If the parents are not married, the mother initially has sole custody - the father acquires it only through a joint custody declaration, by marrying later or by a court decision. The interactive check asks about your situation and tells you who currently holds custody.

Custody has several components you should keep apart. Personal custody concerns the child's care, upbringing and residence, property custody its financial matters. A particularly practical part is the right to determine residence - it decides where the child lives and is often the real point of dispute in separations. The explainer shows what belongs to custody and what can be governed separately from it.

The distinction from visitation rights matters. Contact and custody are not the same: even a parent without custody generally has a right to contact with the child under Section 1684 of the Civil Code, and the child has a right to contact with both parents. The explainer makes this difference clear, because many conflicts arise precisely from confusing custody and contact.

When parents cannot agree, the family court can be called upon. The procedure under the Family Procedure Act follows fixed steps, often with the involvement of the youth welfare office and, in case of doubt, a guardian ad litem for the child. The explainer describes this course so you know what to expect if a joint solution fails - and so you recognise when agreement is the calmer path.

Above all stands the welfare of the child. It is not a gut feeling but a legal standard with criteria - attachment, continuity, support, the child's wishes depending on age. The explainer offers you a child-welfare checklist that makes these aspects tangible, without claiming to replace a court's assessment.

The explainer is part of Plus. For the summary your entries go to our server in Germany and are not stored there. The explainer is a tool for understanding, not legal advice. In real conflicts the youth welfare office, counselling services and specialist lawyers take you further. But anyone who knows the terms, the responsibilities and the process walks into every conversation calmer and better prepared - in the child's interest.

Częste pytania

Who has custody if the parents are not married?

Initially the mother alone. The father acquires joint custody through a joint custody declaration, by marrying later or by a court decision. The explainer's interactive check determines for your situation who holds custody.

What is the difference between custody and visitation?

Custody covers decisions on the child's care, upbringing, residence and property. Visitation under Section 1684 of the Civil Code concerns personal contact. Even a parent without custody generally has a right to contact, and the child has a right to contact with both parents.

What is the right to determine residence?

It is the part of custody that determines where the child lives. In a separation it is often the central point of dispute, for example if one parent wants to move. In certain cases it can also be governed separately from the rest of custody. The explainer sets out the connections.

What does child welfare mean in practice?

Child welfare is the legal standard for all custody decisions. It includes criteria such as the child's attachment, continuity and stability, support and, depending on age, the child's wishes. The child-welfare checklist makes these aspects tangible but does not replace a court's assessment.

How does a custody procedure work?

If parents cannot agree, the family court decides under the Family Procedure Act. The procedure follows fixed steps, often with the youth welfare office and, in case of doubt, a guardian ad litem for the child. The explainer describes the typical course so you know what to expect.

Does the explainer replace legal advice?

No. It helps you understand the terms, responsibilities and process. In real conflicts or court proceedings you should turn to the youth welfare office, a counselling service or a specialist family lawyer.
