Why do I have to acknowledge paternity at all?
For unmarried parents legal fatherhood does not arise automatically. Without acknowledgment under Section 1592 no. 2 BGB the father has no custody, the child no secured support and inheritance claim, and no father is listed on the birth certificate. Acknowledgment creates the legal basis.
Where can I acknowledge paternity and what does it cost?
The acknowledgment must be officially certified. At the Youth Welfare Office this is free, at the registry office a possible fee depends on the municipality, at a notary there is a fee. For most cases the Youth Welfare Office is the simplest and cheapest choice.
Can I acknowledge paternity before the birth?
Yes. Prenatal acknowledgment is expressly possible and often sensible: the father is then on the birth certificate from the start. You usually need the maternity record with the expected due date. The mother's consent is always required.
Do I automatically get custody with the acknowledgment?
No - this is the most common misconception. Paternity acknowledgment establishes legal fatherhood, but not joint custody. For that you also need the custody declaration under Section 1626a BGB, submitted at the Youth Welfare Office or a notary.
What if the mother is still married?

Can a paternity be challenged?
