Wohnflächen-Checker - Contrôle de la surface habitable

Does your lease claim more floor area than the flat really has? Your actual living space under the German Living Space Ordinance - balconies at just 25 percent, sloped ceilings pro rata, cellars not at all. If reality deviates a lot, a rent reduction may even be on the table. This page is a preview with an example and an explanation; the actual calculation opens after you sign in with Plus.

Ce que sait faire Wohnflächen-Checker - Contrôle de la surface habitable

Living area sounds simple, but it is not. The square-metre figure in your lease is by no means always the space you actually live in. Under the German Living Space Ordinance a balcony or terrace usually counts at only 25 percent, a room under a sloped ceiling only partly, and an unheated cellar or garage not at all. That is exactly where the checker comes in: it calculates your real countable area, room by room.

You add your rooms and pick a type for each: regular room, room with a sloped ceiling, balcony, terrace, loggia, heated or unheated conservatory, cellar, garage or other. For each type the tool knows the correct WoFlV factor and the relevant legal basis - a balcony under Section 4 No. 4 at 25 percent, a regular room under Section 2 at full area.

Sloped ceilings are the classic case where landlords like to miscalculate. Areas under a ceiling height of one metre do not count at all, between one and two metres only half, and only from two metres up fully. The checker asks for exactly these three height ranges and works out the countable area for you, instead of you crouching in the attic with a folding ruler and calculator.

The real highlight is the deviation calculator. Enter the area stated in your lease, your base rent, the service charge prepayment and the start of the tenancy, and the tool compares it with the actual area. If the flat is more than 10 percent smaller than agreed, the rent is reduced according to the Federal Court of Justice, usually based on the total rent. The tool shows the deviation, the monthly and yearly reduction and the refund since the start of the tenancy, minus payments that are already time-barred.

Important context: this is a calculation aid, not legal advice and not a court ruling. The 10 percent threshold comes from case law, but every case is different, and actually enforcing a reduction is something you should clarify with a tenants association or a lawyer. The checker hands you the numbers you need to even start that conversation.

The calculation runs in your browser, with no data transfer. Your inputs stay in this browser under your account until you sign out, and you can print the breakdown. You can load presets for typical flats to get a feel for the maths, and adjust your own rooms until the area is right. In the end you have a transparent breakdown that lets you meet your landlord as an equal.

Fonctions

Calculation per Living Space Ordinance

Each room type gets its correct WoFlV factor, with the relevant section cited.

Sloped ceilings in three tiers

Under 1 m does not count, 1 to 2 m counts half, from 2 m fully. The tool crunches the height ranges for you.

Balcony, terrace and loggia

Outdoor areas usually count at only 25 percent - exactly what landlords like to bill in full.

Deviation calculator

Compares the lease area with the actual area and shows the percentage deviation with a traffic-light status.

Estimate a rent reduction

From over 10 percent deviation the tool estimates a possible reduction per month, year and retroactively. Not legal advice.

Presets for typical flats

Ready-made example flats show you how the maths works before you enter your own rooms.

    Compare the lease area

Enter the area stated in your lease, base rent, service charge prepayment and the start of the tenancy to see the deviation, reduction and refund.

  4. 4

    Read the result

Look at the actual area, the deviation and the estimated rent reduction - then clarify enforcement with an expert.

Pour qui

→Anyone with an attic flat where slopes change the area a lot.
→Landlords wanting to state the living area correctly and defensibly.
→Tenants who need numbers for a rent-reduction conversation.

Questions fréquentes

Does the balcony count as living area?

Usually only at 25 percent. Under Section 4 No. 4 of the Living Space Ordinance, balconies, terraces and loggias are typically counted at a quarter, in exceptional cases with especially high-quality features at up to 50 percent. They never count in full.

How are sloped ceilings calculated?

Staggered by ceiling height: areas under one metre do not count at all, between one and two metres count half, and only from two metres up fully. The checker asks for these three ranges and computes the countable area.

When can I reduce the rent?

Case law has repeatedly recognised a reduction claim where the area deviates by more than 10 percent to the tenant’s disadvantage. But it depends on the individual case. The tool provides the numbers; clarify actual enforcement with a tenants association or a lawyer.

Does the cellar count?

No. Cellars, garages, boiler rooms and other ancillary rooms do not count towards the living area under the Living Space Ordinance (§ 2 (3) WoFlV). The WoFlV usually applies when the lease agrees nothing else.

Is this a binding calculation?

No, it is a calculation aid based on the Living Space Ordinance, not an official survey and not legal advice. A court-proof area may require an expert appraisal. Use the numbers as a solid basis for the conversation with your landlord.

Does my data stay private?

Yes. The entire calculation runs in your browser. Your room measurements and rent data are not sent to a server and stay on your device.
