Vaterschaftsanerkennung-Helper

Becoming a father is one thing - being one legally is another. If you are not married, legal fatherhood does not arise on its own, it must be acknowledged. The paternity recognition helper walks you through it step by step: a scenario quiz, a document checklist, Youth Welfare Office or notary, the custody declaration, costs and challenges. Clearly explained, with the right sections (BGB Sections 1592-1600e).

Vaterschaftsanerkennung-Helper neler yapar

In Germany, for unmarried parents only the mother is initially a legal parent - the father becomes one through paternity acknowledgment. Without this step the father has no custody, no secured contact rights, and the child has no support or inheritance claim against him. The helper makes clear why the acknowledgment matters and how it plays out in your specific case.

It starts with a short scenario quiz. Depending on the mother's marital status and your situation you land in one of four paths: unmarried parents (the standard case), mother still married to another man or recently divorced, an international case with foreign documents or nationalities, or a challenge to an existing paternity. Each path has its own guide, its own pitfalls and the matching section references.

Then it gets practical: the document checklist tells you exactly what to bring - ID card or passport, birth certificate, for prenatal acknowledgment the maternity record, for international cases translated and apostilled documents. The acknowledgment itself must be officially certified. That is free at the Youth Welfare Office or the registry office, or for a fee at a notary. The helper compares the venues with costs and a recommendation, so you do not pay unnecessarily.

Timing is a big topic. You can acknowledge paternity before the birth (prenatal) or after (postnatal). The prenatal route has the advantage that the father is on the birth certificate from the first second and can act immediately if needed. The helper contrasts both paths with their pros and cons, so you pick the right one.

Important to know: paternity acknowledgment alone does not create joint custody. For that you also need the custody declaration under Section 1626a BGB, which you also submit at the Youth Welfare Office or a notary. The helper explains the difference many parents miss and guides you through the declaration, so you do not live under the false belief that acknowledgment settled everything.

The helper also covers the ugly cases: challenging paternity under Sections 1600ff BGB with its deadlines, and what applies if the mother was still married at the time of birth - because then the husband is legally the father first, regardless of who the biological one is. Everything runs in your browser, with your answers saved as a local draft. It does not replace legal advice, but it makes sure you arrive at the office prepared instead of surprised.

Sık sorulan sorular

Why do I have to acknowledge paternity at all?

For unmarried parents legal fatherhood does not arise automatically. Without acknowledgment under Section 1592 no. 2 BGB the father has no custody, the child no secured support and inheritance claim, and no father is listed on the birth certificate. Acknowledgment creates the legal basis.

Where can I acknowledge paternity and what does it cost?

The acknowledgment must be officially certified. At the Youth Welfare Office this is free, at the registry office a possible fee depends on the municipality, at a notary there is a fee. For most cases the Youth Welfare Office is the simplest and cheapest choice.

Can I acknowledge paternity before the birth?

Yes. Prenatal acknowledgment is expressly possible and often sensible: the father is then on the birth certificate from the start. You usually need the maternity record with the expected due date. The mother's consent is always required.

Do I automatically get custody with the acknowledgment?

No - this is the most common misconception. Paternity acknowledgment establishes legal fatherhood, but not joint custody. For that you also need the custody declaration under Section 1626a BGB, submitted at the Youth Welfare Office or a notary.

What if the mother is still married?

If the mother was married at the time of birth, her husband is legally the father first (Section 1592 no. 1 BGB), regardless of biology. For the biological father to acknowledge, the existing paternity must be challenged. The helper guides you through this special case.

Can a paternity be challenged?

Yes, under Sections 1600ff BGB. Those entitled to challenge include the legal father, the mother, the child and, under conditions, the biological father. Deadlines apply (generally two years from becoming aware of the circumstances). For a challenge, legal advice is strongly recommended.

Does the helper replace legal advice?

No. The helper explains the procedure, lists documents and costs and points to the right sections so you arrive prepared. For challenges, international cases or disputes between the parents you should consult a family-law specialist.
